The practical source record starts with each packaging component, its material and recorded weight value; the value's unit/batch/period basis must be confirmed before reporting. Add Member-State registration inputs only after the route-to-market scope check identifies the producer and relevant market.

Producer responsibility follows the legal role and route to market, not simply the size or sector of the business. Article 3(1)(15) defines several producer cases, including cross-border operators that first make packaged products available directly to end users in another Member State.

Article 44 requires Member States to establish PPWR producer registers within 18 months after the first Article 44(14) implementing act enters into force. Registered producers report packaging quantities by weight; below 10 tonnes uses the simplified Annex IX dataset unless a Member State lowers the threshold. Current national obligations and formats still require market-specific verification.

PPWR applies generally from 12 August 2026. Article 70 repeals Directive 94/62/EC subject to stated transitions; it does not say that every national packaging act disappears. National registration, fees, representation and enforcement details therefore still need market-specific confirmation.

Wer muss PPWR einhalten?
A person who meets one of the producer cases in Article 3(1)(15) must register where required and report packaging data. An importer is separately defined in Article 3(1)(17), so the first-placement route must be captured instead of assuming that every importer has the same role.

A producer in the direct-to-end-user cross-border cases in Article 3(1)(15)(c) or (d) must appoint an authorised representative for EPR in each relevant Member State. Article 45(3) also allows Member States to require representation from other third-country producers, so Clearlane asks for the route before treating representation as mandatory.

Using a Producer Responsibility Organisation is not a universal PPWR requirement. A producer may entrust EPR obligations to a PRO, and a Member State may make that entrustment mandatory; the registration record describes how the producer meets its responsibility and includes a PRO certificate where Article 46(1) applies.

Design-for-recycling and recycled content
This is the earliest statutory date. Article 6 applies on 1 January 2030 or 24 months after the relevant delegated act, whichever is later; Article 7 applies on 1 January 2030 or three years after the Article 7(8) implementing act, whichever is later. Grades A, B and C and the percentages are in the act, but methods and the operative date can still depend on those acts.

Member States must establish effective, proportionate and dissuasive penalties for infringements and take the measures needed to ensure implementation. The exact sanction and enforcement route therefore depends on the applicable national measure; Clearlane does not invent a universal fine.

Once the relevant Article 44 registration requirement applies, a producer may not make packaging available for the first time in a Member State unless registered there or acting through an authorised representative registered there. Existing national registration duties may apply separately. That consequence is distinct from any national penalty amount.
